Section 21 Notice and Section 8 Notice in Wales – how much notice needs to be provided?

We provided you with regular updates over the course of the last year in relation to the notice period required when serving a Section 21 Notice and Section 8 Notice in Wales.

Between the 29th of September 2020 and the 24th of March 2022, a landlord was required to provide 6 months’ notice if serving a Section 21 Notice and Section 8 Notice (there were very limited circumstances where the notice could be less than 6 months).

The requirement to provide 6 months notice came to an end on the 24th of March 2022.

2 months notice – Section 21 Notice

This means that all notices served after the 24th of March have reverted to the ‘pre-covid’ requirements; 2 months’ notice for all Section 21 Notices, and the notice period required for Section 8 Notices will vary depending on the grounds relied upon (none of which require 6 months’ notice to be given).

However, changes in legislation on the 15th of July 2022 will mean that the notice period required when serving a Section 21 Notice will change to 6 months indefinitely. There are also some significant other changes being introduced to housing law in Wales from the 15th of July onwards due to the Renting Home Wales Act 2016. We will provide you with further updates in due course.

Of course, serving notice is always subject to the preconditions to ensure that all relevant legislation including registration and licencing with Rent Smart Wales (Wales only) and deposit protection rules have been complied with. Care must also be taken when drafting notices to ensure that the notices are valid.
