Are you entering into a new tenancy agreement on or after the 1st of December 2022?

The Renting Homes (Wales) Act 2016 comes into force on the 1st of December 2022.

This means that any new tenancy agreement entered into on or after the 1st of December 2022 will be an occupation contract and not an assured shorthold tenancy agreement. Landlords will need to provide tenants with occupation contracts on any new agreement entered into on or after the 1st of December 2022.

Landlords have 14 days to provide the tenants with the occupation contract (from the date occupation starts). Failure to provide a tenant with an occupation contract will impact the landlord’s ability to obtain possession of the property (and potentially other consequences).

Make sure that you are prepared for these changes and have all the documents in place ready for the 1st of December.
