Gamlins Law helps secure £25.6 million settlement for claimant with lifelong care needs

Gamlins Law has helped secure a £25.6 million lump sum settlement for a claimant who suffered profound and permanent physical and cognitive disabilities following an incident at work resulting in premature birth.
The settlement, which was approved by the High Court, is understood to be one of the largest lump sum settlements ever approved in a negligence claim.

The claimant was represented by Gamlins Law, who instructed Will Waldron KC and Tony Goff of Exchange Chambers.

The case involved complex issues around liability and the claimant’s lifelong needs, including specialist care, therapies, equipment, accommodation and wider support. The award will provide long-term financial security and ensure the claimant has access to the support required throughout their lifetime.

For the claimant’s family, the settlement brings an important degree of certainty after many years of uncertainty, legal process and personal difficulty. While no amount of compensation can change what happened, the settlement will make a significant difference to the claimant’s quality of life and future care.

Sally Richards, Chartered Legal Executive at Gamlins Law, said:
“This has been an incredibly important case for the claimant and their family. Initially the defendant vigorously denied any responsibility for the injuries. However, after an admission of liability and causation had been secured, our role was to make sure the full extent of the claimant’s lifelong needs was carefully investigated, properly evidenced and clearly presented.

Cases involving serious and permanent injury require detailed preparation, patience and a clear understanding of how the injuries will affect every part of a person’s life and into their future years, as well as the needs of the immediate family, while supporting them through the litigation process. That includes care, therapy, specialist equipment, suitable accommodation and the support needed by the family around them.

It has been a privilege to support the family through such a difficult and lengthy process. The settlement gives the family assurance and financial certainty to plan properly, make decisions with confidence and put the right long-term support in place around the claimant.

A sincere thank you to the professionalism of Will Waldron KC and Tony Goff of Exchange Chambers, together with the team of experts in helping achieve this outcome.”

Will Waldron KC commented:
“Securing this settlement marks the culmination of many years of hard work on behalf of the claimant and their family, whom it was a privilege to know and represent. While no award can undo the devastating consequences of the injuries suffered, this settlement will ensure that the claimant has access to the specialist care, support and opportunities they will require throughout their lifetime.

“It was a privilege to work with Sally Richards and the team at Gamlins Law Solicitors. Their tireless commitment to their client, together with the unwavering support and complete dedication of the claimant’s family, played a vital role in achieving this outcome.”
